OVERVIEW
Welcome to Biscotto Stone.
Throughout these Terms and Conditions, the terms “Biscotto Stone”, “we”, “us” and “our” refer to Francesco Sorbo as the operator of this online store.
Our online store is powered by Shopify, which provides the e-commerce platform through which we offer our products and related services.
These Terms and Conditions (“Terms”) govern access to and use of our website and purchases made through our online store. They contain important information concerning products, orders, payments, processing and delivery times, customs duties, international shipments, returns, handmade refractory stones, proper product use, statutory consumer guarantees and liability.
Our store accepts orders for delivery to selected countries within and outside the European Union, as made available at checkout. We currently do not offer delivery to Italy.
By placing an order, the customer acknowledges having had the opportunity to review these Terms together with our Privacy Policy, Refund Policy, Shipping Policy and the information displayed on the relevant product page.
Nothing in these Terms excludes, restricts or limits any mandatory consumer right that cannot lawfully be excluded or limited.
SECTION 1 – USE OF THE SERVICES AND CUSTOMER ACCOUNTS
You may use the Services and place an order only if you have the legal capacity required to enter into a binding contract under the law applicable to you.
When placing an order or creating an account, you may be required to provide information including your name, email address, billing details, delivery address and payment information.
You are responsible for ensuring that all information supplied is accurate, complete and current.
Where a customer account is created, you are responsible for maintaining the confidentiality and security of your account credentials.
You should promptly inform us if you reasonably believe that your account has been accessed or used without authorization.
SECTION 2 – PRODUCTS, HANDMADE NATURE AND NATURAL VARIATIONS
2.1 Product information
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, technical characteristics and other information displayed on our website are accurate.
Images are provided for illustrative purposes. Colors, shades, textures and surface appearance may vary depending on lighting, screen settings and the individual characteristics of each product.
2.2 Handmade and artisanal production
Biscotto Stone refractory stones are handmade artisanal products and are not standardized industrial mass-produced goods.
Because they are produced by hand using refractory materials, each stone may have individual characteristics and natural differences compared with another stone of the same type.
Individual products may therefore present minor variations in:

color;
-
shade;
-
texture;
-
porosity;
-
surface appearance;
-
finish;
-
shape;
-
thickness; or
-
dimensions.
These natural and artisanal variations do not, by themselves, constitute a lack of conformity where they do not materially affect the normal intended use, safety, functionality or characteristics expressly promised at the time of purchase.
Each handmade stone may therefore have individual visual and physical characteristics and should not be expected to be perfectly identical to another stone or to photographs displayed on the website.
2.3 Product specifications
Product dimensions and characteristics are stated on the relevant product page.
Reasonable tolerances inherent in handmade production may apply where indicated or where consistent with the artisanal nature of the product.
Nothing in this Section restricts any mandatory statutory rights relating to a genuine lack of conformity.
SECTION 3 – ORDERS AND FORMATION OF THE CONTRACT
Submitting an order constitutes an offer by the customer to purchase the selected products.
Before placing an order, the customer is responsible for reviewing the selected product, dimensions and specifications, quantity, price, delivery address, billing information, stated processing time, shipping information and any product-specific information displayed before purchase.
The contract is concluded when Biscotto Stone accepts the order through the order confirmation process used by our store.
Payment must be successfully authorized where payment authorization is required.
We may refuse or cancel an order for legitimate reasons including:

suspected fraud or unauthorized payment;
-
payment failure;
-
product unavailability;
-
incorrect or incomplete customer information;
-
obvious pricing or technical errors;
-
quantities inconsistent with reasonable retail use;
-
unlawful activity; or
-
material violation of these Terms.
Where an order is cancelled after payment has been collected, any amount legally due will be refunded using the original payment method unless otherwise agreed or required by applicable law.
Once an order has entered preparation, production or shipment, requested modifications may no longer be possible.
This does not affect any statutory right of withdrawal or other mandatory consumer right.
SECTION 4 – PRICES, TAXES AND PAYMENT
The price applicable to an order is the price displayed before the order is submitted, subject to correction of obvious errors in accordance with applicable law.
The amount payable directly to Biscotto Stone will be displayed before the customer places the order and will include applicable taxes collected by Biscotto Stone and shipping charges payable to us.
For international orders, the amount paid to Biscotto Stone does not include customs duties, import VAT, customs clearance charges, brokerage fees or other import charges imposed at destination, unless expressly stated otherwise.
Prices, promotions and discounts may change from time to time.
Where required by applicable consumer legislation, price reductions will be presented in accordance with applicable prior-price rules.
Customers must provide valid and accurate billing and payment information.
By providing a payment method, the customer confirms that they are authorized to use it and authorizes the relevant payment service providers to process the transaction.
SECTION 5 – PROCESSING, SHIPPING AND DELIVERY
5.1 Variable processing times
Because Biscotto Stone products are handmade and may require different preparation, production or availability periods, processing times are not identical for every product or throughout the year.
The applicable estimated processing or dispatch time is displayed on the relevant product page before the customer places the order.
Depending on the product, availability, production cycle, order volume and period of the year, processing times may range from a few business days to several weeks.
Customers should carefully review the processing information shown on the relevant product page before completing the purchase.
The processing timeframe displayed at the time the order is placed is the estimated timeframe applicable to that order, subject to circumstances outside our reasonable control.
Where an order contains several products with different processing times, the order may be dispatched when all products are ready unless otherwise stated or agreed.
Processing time refers to the period required to prepare and dispatch the order and is separate from the carrier's transportation time.
5.2 Delivery period
Carrier transit times depend on the destination country and shipping service.
Where available, estimated transit information may be displayed during the purchasing process, on the relevant product page, at checkout or in our Shipping Policy.
Unless expressly guaranteed, stated delivery dates and transit times are estimates.
Where no different delivery period has been agreed, delivery will take place within the period required by applicable law.
Where a product requires a longer production, processing or delivery period, that information will be displayed before purchase. By placing the order after being informed of the stated timeframe, the customer agrees to that timeframe to the extent permitted by applicable law.
5.3 Delays
Processing and delivery may be affected by circumstances outside our reasonable control, including:

carrier delays;
-
customs and border procedures;
-
severe weather;
-
strikes;
-
transportation disruptions;
-
public authority measures;
-
exceptional order volumes;
-
customs inspections; or
-
force majeure events.
Mandatory consumer rights relating to delayed delivery remain unaffected.
5.4 Delivery information
Customers are responsible for providing a complete and accurate delivery address and any other information reasonably necessary to complete delivery.
We are not responsible for delays, failed deliveries or additional costs directly resulting from incorrect or incomplete information supplied by the customer, to the extent permitted by applicable law.
5.5 Risk during delivery
For transactions with consumers, the risk of loss or damage remains with Biscotto Stone until the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods, where required by applicable law.
Where the customer independently appoints a carrier that was not offered by Biscotto Stone, different rules concerning transfer of risk may apply in accordance with applicable law.
SECTION 6 – CUSTOMS DUTIES, IMPORT TAXES AND INTERNATIONAL SHIPMENTS
6.1 Duties and import charges
Orders shipped to destinations outside the European Union, or to other destinations subject to customs and import formalities, may be subject to:
-
customs duties;
-
import VAT or similar import taxes;
-
customs clearance charges;
-
carrier brokerage or disbursement fees;
-
handling fees; or
-
other charges imposed by the destination country or carrier in connection with importation.
Biscotto Stone does not collect, receive or pay these import charges on behalf of the customer.
Where applicable, these amounts are entirely the responsibility of the customer and are requested directly from the customer by the shipping carrier, customs authority or other competent authority responsible for importing the goods.
These amounts are determined by authorities, customs agencies and/or carriers and are outside Biscotto Stone's control.
The customer is responsible for understanding and complying with any customs and import requirements applicable in the destination country and for paying any amount required to complete customs clearance and delivery.
Biscotto Stone cannot guarantee or predict the amount of customs duties, import taxes or carrier clearance charges that may be imposed.
Customers who require information regarding possible import charges should contact the relevant customs authority in their destination country before placing an order.
6.2 Customer's responsibility for customs clearance
Where customs authorities or the carrier require payment, documentation, identification, authorization or other information from the recipient in order to clear the shipment, the customer is responsible for providing what is reasonably required and completing the import process.
Failure to respond to the carrier or customs authorities, failure to provide required information or failure to pay the applicable import charges may prevent delivery and may result in the shipment being returned to Biscotto Stone, stored, abandoned or destroyed in accordance with the carrier's or customs authority's procedures.
6.3 Refusal of delivery or failure to pay import charges
If a customer:
-
refuses to accept the shipment;
-
refuses or fails to pay applicable customs duties, import taxes or other import charges;
-
fails to complete customs clearance;
-
fails to provide information reasonably required by the carrier or customs authorities;
-
fails to collect the shipment where collection is required; or
-
otherwise causes the shipment to be returned to Biscotto Stone,
the customer will be responsible, to the extent permitted by applicable law, for the actual costs directly resulting from the failed delivery and return.
Where the shipment is returned to Biscotto Stone, any refund that is legally due will normally be processed after the goods have been received and their condition assessed.
To the extent permitted by applicable law, Biscotto Stone may deduct from any refund due to the customer the actual and documented costs incurred as a direct consequence of the customer's refusal or failure to complete delivery or importation.
Such costs may include, where applicable:
-
return shipping charges;
-
return-to-sender charges;
-
carrier handling fees;
-
brokerage fees;
-
customs clearance fees;
-
storage costs;
-
administrative or disbursement charges imposed by the carrier;
-
import or export charges imposed on Biscotto Stone as a consequence of the return; and
-
any other documented cost directly caused by the failed delivery or return.
Any deduction will be limited to costs actually incurred and will not constitute an arbitrary penalty.
6.4 Original shipping charges
Where permitted by applicable law, if a shipment is returned because the customer refused delivery, failed to pay import charges or failed to complete customs clearance, any original shipping costs that are non-refundable to Biscotto Stone may also be excluded from the amount refunded.
This provision does not apply where the failed delivery was caused by Biscotto Stone, by a lack of conformity of the product, or by another circumstance for which Biscotto Stone is legally responsible.
6.5 Abandoned or destroyed shipments
Where a shipment is abandoned, destroyed, disposed of or otherwise not returned to Biscotto Stone because the customer refused or failed to pay import charges, complete customs clearance or cooperate with the carrier, any refund will be assessed according to the actual circumstances, loss incurred and applicable law.
Biscotto Stone will not be required to refund amounts that applicable law permits us to retain in respect of goods that cannot be recovered or costs directly caused by the customer's failure to complete importation.
6.6 Refusal of delivery and right of withdrawal
Where applicable law requires a customer to expressly communicate a decision to exercise a statutory right of withdrawal, merely refusing delivery or failing to pay customs duties does not, by itself, constitute an unequivocal notice of withdrawal.
Customers wishing to exercise a statutory right of withdrawal should communicate that decision to Biscotto Stone in accordance with our Refund Policy and applicable law.
Nothing in this Section restricts any mandatory consumer right that cannot lawfully be excluded.
SECTION 7 – REFRACTORY STONES, PRODUCT USE AND THERMAL SHOCK
7.1 Nature of refractory materials
Biscotto Stone refractory stones are handmade products manufactured from refractory materials.
They are designed to withstand the high temperatures associated with their intended use when correctly installed, maintained and used.
However, refractory materials are rigid and inherently fragile and may crack or break when subjected to inappropriate mechanical or thermal stress.
The inherent fragility of refractory material does not, by itself, mean that a product is defective.
7.2 Product instructions
Usage and maintenance instructions are supplied with our refractory stones.
Customers should carefully read and follow these instructions before using the product.
Failure to follow the supplied instructions may expose the stone to circumstances capable of causing cracks, breakage or other damage.
Depending on the circumstances, damage may result from:
-
thermal shock;
-
sudden or excessive temperature changes;
-
excessively rapid heating;
-
excessively rapid cooling;
-
uneven heating;
-
residual moisture;
-
heating a wet or insufficiently dried stone;
-
contact between liquids and a hot stone;
-
unsuitable, unstable or uneven support;
-
accidental impact;
-
dropping or striking the stone;
-
moving or handling the stone while hot;
-
unsuitable cleaning procedures;
-
modification or alteration of the stone;
-
use in equipment for which the product is unsuitable; or
-
use contrary to the supplied instructions.
7.3 Initial uses and thermal shock
Refractory materials may be particularly sensitive to inappropriate thermal stress during heating and cooling cycles.
The occurrence of a crack during the first uses does not, by itself, establish the existence of a manufacturing defect or original lack of conformity.
Where a stone has been delivered intact, cracking during or shortly after the first heating or cooling cycles may be consistent with thermal stress or thermal shock, particularly where the stone has been exposed to:
-
rapid temperature changes;
-
uneven heating;
-
excessively rapid heating or cooling;
-
residual moisture;
-
contact with liquids while hot;
-
heating while wet or insufficiently dried;
-
unsuitable positioning or support; or
-
heating and cooling procedures inconsistent with the supplied instructions.
At the same time, a crack will not automatically be classified as thermal shock merely because it occurred after delivery or during the first uses.
Every claim will be assessed individually on the basis of the circumstances, available evidence and mandatory applicable law.
7.4 Assessment of cracks and breakage
A crack or break in a refractory stone may have different causes.
The occurrence of a crack or break does not, by itself, determine whether the cause was an original lack of conformity or a circumstance occurring after delivery.
When assessing a claim concerning a cracked or broken stone, Biscotto Stone may reasonably request information and evidence including:
-
photographs of the entire stone;
-
detailed photographs of the crack or fracture;
-
photographs of both sides and edges of the product;
-
information concerning the oven or equipment used;
-
information concerning how the stone was positioned and supported;
-
operating temperatures;
-
heating procedures;
-
cooling procedures;
-
cleaning and maintenance procedures;
-
information concerning possible exposure to moisture or liquids;
-
information regarding any movement or handling while hot; and
-
any other information reasonably relevant to determining the cause of the damage.
Relevant factors may include:
-
the condition of the product at delivery;
-
the nature and location of the fracture;
-
any visible evidence of impact or thermal stress;
-
the way in which the product was installed and used;
-
compliance with the supplied instructions;
-
the handmade nature of the product;
-
the characteristics of refractory materials;
-
the period elapsed since delivery; and
-
any other relevant technical evidence.
Where the available evidence establishes that damage was caused after delivery by thermal shock, impact, moisture, misuse, improper handling, failure to follow the instructions or another external cause, such damage does not constitute an original lack of conformity.
Nothing in this Section alters or reverses any statutory presumption, burden-of-proof rule or other mandatory consumer right applicable to the transaction.
SECTION 8 – DAMAGE DURING TRANSPORT
Biscotto Stone takes reasonable measures to package its handmade refractory stones appropriately for transportation.
If a stone is received broken or materially damaged, the customer should contact us as soon as reasonably possible at:
To allow us to assess the damage and, where appropriate, submit a claim to the carrier, we may reasonably request photographs showing:
-
the product as received;
-
the external packaging;
-
the internal protective packaging;
-
any visible damage to the parcel; and
-
the shipping label.
Customers should retain the packaging and damaged product where reasonably possible until the claim has been assessed.
These requests are intended to facilitate investigation of transport damage and do not restrict mandatory statutory rights.
Where damage occurred before risk passed to the consumer, the remedies required by applicable law remain available.
SECTION 9 – RETURNS, RIGHT OF WITHDRAWAL AND REFUNDS
9.1 European Union consumers
For qualifying distance purchases by consumers within the European Union, the customer generally has the right to withdraw from the contract within 14 days from receipt of the goods, without providing a reason, subject to the exceptions permitted by applicable law.
The customer must communicate their decision to exercise the right of withdrawal in accordance with our Refund Policy.
Merely refusing delivery does not replace an express notification of withdrawal where applicable law requires such notification.
9.2 Return costs following withdrawal
Unless otherwise required by applicable law, the direct cost of returning goods following the exercise of the right of withdrawal is borne by the customer where the customer was informed of this obligation before purchase.
This must be distinguished from a claim concerning a genuinely defective or non-conforming product, for which the applicable statutory guarantee rules apply.
9.3 Handling of returned goods
Customers may inspect and handle the goods only to the extent reasonably necessary to establish their nature, characteristics and functioning.
Where permitted by applicable law, the customer may be responsible for any reduction in value resulting from handling beyond what is reasonably necessary for that purpose.
9.4 Customized goods
Where a product is made specifically according to the customer's individual specifications or is clearly personalized, the statutory right of withdrawal may not apply where such an exception is permitted by applicable law.
This does not affect rights relating to genuine defects or lack of conformity.
9.5 Customers outside the European Union
Customers outside the European Union may have different statutory cancellation, return or consumer rights under the law applicable to their transaction.
Nothing in these Terms excludes any mandatory right that applies to such customers.

SECTION 10 – LEGAL GUARANTEE OF CONFORMITY
10.1 European Union statutory guarantee
Consumers purchasing goods within the European Union benefit from the mandatory legal guarantee of conformity provided by applicable EU and national consumer legislation.
Under EU rules, consumers are entitled to a minimum legal guarantee of conformity of two years from delivery for new goods.
Individual EU Member States may provide longer or otherwise more favorable mandatory protections.
Any such mandatory rights remain unaffected.
The statutory legal guarantee cannot be excluded, reduced or replaced by these Terms.
10.2 What the legal guarantee covers
The legal guarantee applies to a lack of conformity for which Biscotto Stone is legally responsible.
A genuine lack of conformity must be distinguished from damage caused after delivery by circumstances such as:

accidental impact;
-
thermal shock;
-
improper handling;
-
improper installation or positioning;
-
unsuitable support;
-
moisture;
-
incorrect heating or cooling;
-
misuse;
-
unsuitable cleaning or maintenance;
-
modification;
-
use contrary to supplied instructions; or
-
other external causes occurring after delivery.
A crack or break therefore does not automatically establish the existence of an original defect.
Likewise, a claim will not be rejected solely because the product was delivered intact.
Each claim will be assessed individually according to the circumstances, available evidence and applicable law.
10.3 Statutory presumptions
Under EU consumer protection rules, where an alleged lack of conformity becomes apparent within at least one year from delivery, it is generally presumed to have existed when the goods were delivered unless the seller proves otherwise or unless that presumption is incompatible with the nature of the goods or the nature of the alleged lack of conformity.
Certain EU Member States provide a longer period for this presumption, including up to two years.
Nothing in these Terms reduces or reverses any more favorable statutory rule applicable in the consumer's country of habitual residence.
10.4 Remedies
Where a genuine lack of conformity exists, the consumer is entitled to the remedies provided by the applicable consumer protection legislation.
Depending on the circumstances and applicable law, these remedies may include:

repair;
-
replacement;
-
an appropriate price reduction; or
-
termination of the sales contract and reimbursement.
Repair or replacement will be provided free of charge where required by applicable law and within a reasonable period without significant inconvenience to the consumer.
10.5 No additional accidental-breakage guarantee
Unless expressly stated otherwise in writing, Biscotto Stone does not provide a separate voluntary commercial guarantee that a refractory stone will remain free from cracks or accidental breakage for a specified period.
In particular, no additional commercial guarantee is provided against damage demonstrated to have resulted from:

accidental impact;
-
thermal shock;
-
moisture;
-
improper handling;
-
misuse;
-
incorrect installation or support;
-
failure to follow the supplied instructions; or
-
another external cause occurring after delivery.
This provision does not restrict any mandatory statutory legal guarantee.
10.6 Customers outside the European Union
For customers outside the European Union, any mandatory statutory warranties or consumer guarantees applicable to the transaction remain unaffected.
Nothing in these Terms excludes a right or remedy that cannot lawfully be excluded under the law applicable to the customer.
SECTION 11 – INTELLECTUAL PROPERTY
Unless otherwise stated, all content made available through the Services, including trademarks, trade names, logos, photographs, videos, graphics, text, product descriptions, designs and layouts, is owned by Biscotto Stone, its licensors or the relevant rights holder.
Such materials are protected by applicable intellectual property laws.
Users may access the Services for lawful personal and non-commercial purposes.
Without prior authorization, protected content may not be reproduced, distributed, commercially exploited, modified or republished except where permitted by applicable law.
Third-party intellectual property remains the property of its respective rights holders.
SECTION 12 – THIRD-PARTY TOOLS AND SERVICES
Our website may provide access to applications, payment services, integrations or other functionality supplied by third parties.
Such services may be subject to separate third-party terms and privacy policies.
To the extent permitted by applicable law, Biscotto Stone is not responsible for failures exclusively attributable to independent third-party services outside our reasonable control.
Nothing in this Section limits any responsibility imposed directly on Biscotto Stone by mandatory law.
SECTION 13 – THIRD-PARTY LINKS
The Services may contain links to websites or platforms operated independently by third parties.
These links are provided for convenience and do not necessarily imply endorsement.
Biscotto Stone is not responsible for the content, privacy practices, security or availability of third-party websites outside our control.
Customers should review the applicable terms and privacy policies before using third-party services.
SECTION 14 – RELATIONSHIP WITH SHOPIFY
Our online store uses Shopify's technology and e-commerce platform.
Shopify provides the technical platform that enables Biscotto Stone to operate the online store but is not the seller of Biscotto Stone products unless expressly indicated otherwise.
Contracts for the purchase of Biscotto Stone products are concluded with Biscotto Stone.
Questions or claims relating to products, orders, deliveries, refunds or guarantees should therefore be addressed to Biscotto Stone unless applicable law or a specific Shopify service provides otherwise.
SECTION 15 – PRIVACY AND PERSONAL DATA
Personal data collected through our Services is processed in accordance with our Privacy Policy and applicable data protection legislation, including the GDPR where applicable.
Because the online store is hosted by Shopify, certain customer information may also be processed by Shopify and other service providers involved in operating the website, processing payments, preventing fraud, fulfilling orders, shipping products or providing technical services.

SECTION 16 – REVIEWS, COMMENTS AND USER CONTENT
Customers may voluntarily submit reviews, comments, photographs, suggestions or other content (“User Content”).
By submitting User Content, the customer confirms that they have the necessary rights to provide it.
To the extent permitted by law, the customer grants Biscotto Stone a non-exclusive, worldwide and royalty-free license to use, reproduce and display such content for purposes reasonably connected with operating and promoting our business and products.
User Content must not:

infringe third-party rights;
-
contain unlawful or defamatory material;
-
contain deliberately false or misleading information;
-
contain malware or malicious code;
-
impersonate another person; or
-
otherwise violate applicable law.
We may moderate or remove User Content where reasonably necessary and legally permitted.
SECTION 17 – ERRORS, INACCURACIES AND OMISSIONS
Despite reasonable efforts to maintain accurate information, the website may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, dimensions, specifications, availability, pricing, promotions or shipping.
We may correct obvious errors and update information.
Where an error affects an order already placed, the matter will be handled in accordance with applicable contract and consumer protection law.
SECTION 18 – PROHIBITED USES
The Services may only be used for lawful purposes.
You may not use the Services:

We may suspend or terminate access to accounts or Services where reasonably justified, including in cases of:

material breach of these Terms.
Termination does not affect rights or obligations that arose before termination.
SECTION 20 – LIABILITY
Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful.
Nothing excludes or restricts mandatory consumer rights or liability that cannot legally be excluded.
Biscotto Stone is not responsible, to the extent permitted by applicable law, for damage caused by use of a product contrary to its intended purpose or supplied instructions.
This may include damage caused by:

accidental impact;
-
improper positioning;
-
insufficient or uneven support;
-
improper handling;
-
thermal shock;
-
moisture;
-
incorrect heating or cooling;
-
unauthorized modification; or
-
use in equipment for which the product is unsuitable.
For customers purchasing in the course of a trade, business or profession, liability for indirect or consequential losses may be limited to the maximum extent permitted by applicable law.
Nothing in this Section limits statutory remedies available to consumers.
SECTION 21 – BUSINESS CUSTOMER INDEMNIFICATION
This Section applies only to customers acting for business or professional purposes and only to the extent permitted by applicable law.
A business user may be responsible for reasonable third-party claims or losses directly resulting from their unlawful use of the Services, infringement of third-party rights or material breach of these Terms.
This provision does not apply to consumers where it would conflict with mandatory consumer protection legislation.
SECTION 22 – SEVERABILITY
If any provision of these Terms is held to be unlawful, invalid or unenforceable, it will be interpreted or limited to the minimum extent necessary to make it valid where legally possible.
If this is not possible, the affected provision will be severed.
The remaining provisions will continue in force.
SECTION 23 – WAIVER AND ENTIRE AGREEMENT
Failure by Biscotto Stone to exercise a contractual right does not constitute a waiver of that right.
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, product-specific information, usage instructions and any other terms expressly incorporated into the transaction govern the contractual relationship between Biscotto Stone and the customer.
Nothing in this Section excludes information, representations or rights that applicable law requires to form part of the contract.
SECTION 24 – ASSIGNMENT
Customers may not transfer contractual rights or obligations where such transfer would materially prejudice Biscotto Stone, except where applicable law provides otherwise.
Biscotto Stone may transfer its rights and obligations in connection with a legitimate sale, reorganization or transfer of the business, provided that doing so does not reduce mandatory consumer rights.
SECTION 25 – GOVERNING LAW AND JURISDICTION
These Terms and contracts concluded through the Services are governed by Italian law, subject to applicable rules of private international law.
Where the customer qualifies as a consumer, the choice of Italian law does not deprive the consumer of mandatory protections that cannot lawfully be excluded and which are applicable to that consumer under the relevant rules of private international law.
In particular, where Biscotto Stone directs its commercial activities to the country in which a consumer has their habitual residence, any mandatory consumer protections applicable under the relevant law remain unaffected.
Disputes involving consumers will be determined by the courts having jurisdiction under applicable consumer and private international law.
Where the customer acts exclusively for business or professional purposes and does not qualify as a consumer, disputes may be submitted to the courts having jurisdiction over Biscotto Stone's registered office, to the extent permitted by law.
SECTION 26 – CHANGES TO THESE TERMS
The current version of these Terms will be available on this website.
We may update these Terms where reasonably necessary to reflect changes in applicable law, products, Services, business practices, payment methods or operational requirements.
The version applicable to a purchase will generally be the version in effect when the relevant order is placed.
Changes will not retroactively reduce contractual or statutory rights relating to an order already concluded unless permitted or required by law.
